What Happens After a DUI Arrest

Your license. Your record. Your job. All of it can be affected by what happens in the next few weeks. A DUI case moves fast. You will have a first hearing called the preliminary hearing. After that, your case may resolve through the ARD program, a plea agreement, or a trial. The longer you wait to get help, the fewer options you have. Your license, your record, your job — that’s what’s on the table. Not if I can help it. Call me now and I will tell you exactly where you stand.

First Offense DUI in Pennsylvania

If this is your first DUI, you may be eligible for a program called ARD. That stands for Accelerated Rehabilitative Disposition. ARD is not a conviction. If you complete the program, you may be able to have the arrest expunged from your record. That means it does not show up on background checks.

What ARD Can Mean for You

ARD is not automatic. You have to apply. The district attorney has to approve you. I know how to build the strongest application possible.

Second Offense DUI in Pennsylvania

A second DUI is more serious. Penalties increase significantly. Mandatory minimum jail time applies in most cases. License suspension is longer. The facts of your case matter more than ever. Was the traffic stop legal? Was the test administered correctly? Was there probable cause? These are the questions I ask first.

DUI License Suspension in Pennsylvania

A DUI conviction can suspend your license. So can refusing a chemical test. PennDOT handles license suspensions separately from your criminal case. That means you can face two different proceedings. I handle both.

I have won license suspension appeals, including cases where the client refused the chemical blood test. PennDOT suspended the license. We appealed and won. That is one of the hardest results to get in DUI defense.

How I Defend a DUI Case

I start by looking at everything. The reason the officer pulled you over. How the field sobriety tests were administered. Whether the breathalyzer was properly calibrated. Whether the blood draw followed the right procedures. A DUI charge does not automatically mean a DUI conviction.

One problem in the case can change everything.

Three Real Results That Show What Is Possible

These are real outcomes from real cases. Every case is different. But these examples show what can happen when the facts are on your side.

Not Guilty

Client admitted to drinking beer and smoking marijuana before driving.

All Charges Dismissed

Officer lacked probable cause for the traffic stop. All charges dismissed.

License Suspension Overturned on Appeal

Client refused chemical blood test. PennDOT suspended license. We appealed and won. One of the hardest results to achieve in DUI defense.

*Prior results do not guarantee or predict a similar outcome in any future case. Every case is different and depends on its own specific facts and the applicable law. Nothing on this page is a promise or guarantee regarding the outcome of your matter.

FAQ

Frequently Asked Questions

Will I lose my license for a first DUI in Pennsylvania?
It depends on the results of your blood or breath test, if any, and how we handle the case. A first offense with a lower BAC may result in no suspension. Controlled substances and higher BAC levels carry longer suspensions. Call me and I will tell you exactly what you are facing.
For many first offenders, jail is not required. ARD is one way to avoid it. Your BAC level and the specific charges matter. We will go through the actual numbers together.
ARD is a pretrial program for first-time offenders. If you complete it, you avoid a conviction and may be eligible to have the arrest expunged. Not everyone qualifies. I handle the application process for my clients.
Refusing a test triggers an automatic license suspension through PennDOT. I handle these appeals. I have won them. Call me before you assume it is over.
Probable cause is the legal reason an officer needs before pulling you over. If the stop was illegal, evidence gathered during it can sometimes be thrown out. This is one of the first things I examine in every case.
A conviction stays permanently unless you take action to remove it. If you completed ARD, you may be eligible to have the arrest expunged. I can look at your situation and tell you what your options are.
